To the extent permitted by applicable state law, I hereby consent to this investigation and authorize Western Equipment LLC and/or its subsidiaries, affiliates, other related entities, successors, and/or assigns (the "Company"), to procure consumer report(s), criminal background check(s), consumer credit report(s), investigative consumer report(s) (as defined by the federal Fair Credit Reporting Act) and/or investigative consumer report(s) (as defined by applicable California state law), on my background from a consumer reporting agency ("CRA") or from an investigative consumer reporting agency ("ICRA"), as described in the Background Check Disclosures, the Additional Disclosures, and the California State Law Disclosures (all of which I have received separately from the Company). I have reviewed and understand the information, statements, and notices in the Background Check Disclosures, the Additional Disclosures, and the California State Law Disclosures, as well as this Background Check Authorization. My authorization remains valid throughout my employment with the Company, such that, to the extent permitted by applicable law, I agree Company can procure additional consumer report(s), criminal background check(s), consumer credit report(s), and/or investigative consumer report(s) (as defined by federal law) during my employment without providing additional disclosures or obtaining additional authorizations. Except as otherwise prohibited by state law, I consent to and authorize the Company to share this information with Company's current or prospective clients, customers, others with a need to know, and/or their agents (including but not limited to staffing/placement company clients and vendor credentialing companies) for business reasons (e.g., to place me in certain employment positions, jobs, work sites, etc.).


* EMPLOYEE AGREEMENT AND CONSENT TO DRUG AND/OR ALCOHOL TESTING

I hereby agree, upon a request made under the drug/alcohol testing policy of (the Company), to submit to a drug or alcohol test and to furnish a sample of my urine, breath, and/or blood for analysis. I understand and agree that if I at any time refuse to submit to a drug or alcohol test under company policy, or if I otherwise fail to cooperate with the testing procedures, I will be subject to immediate termination. I further authorize and give full permission to have the Company send me to a laboratory of the company's choosing at the company's expense for a screening test for the presence of any prohibited substances under the policy, and for the laboratory or other testing facility to release any and all documentation relating to such test to the Company and/or to any governmental entity involved in a legal proceeding or investigation connected with the test. Finally, I authorize the Company to disclose any documentation relating to such test to any governmental entity involved in a legal proceeding or investigation connected with the test.
I understand that the Company uses an independent third party, Compliant Background Chex (CBX), to gather information from the laboratory and Medical Reviewing Officer (MRO) and communicate that information to the Company. I understand that only duly-authorized Company officers, employees, and agents will have access to information furnished or obtained in connection with the test; that they will maintain and protect the confidentiality of such information to the greatest extent possible; and that they will share such information only to the extent necessary to make employment decisions and to respond to inquiries or notices from government entities.
I will hold harmless the Company, CBX, and any testing laboratory the Company might use, meaning that I will not sue or hold responsible such parties for any alleged harm to me that might result from such testing, including loss of employment or any other kind of adverse job action that might arise as a result of the drug or alcohol test, even if a Company, CBX, or laboratory representative makes an error in the administration or analysis of the test or the reporting of the results. I will further hold harmless the Company, CBX, and any testing laboratory the Company might use for any alleged harm to me that might result from the release or use of information or documentation relating to the drug or alcohol test, as long as the release or use of the information is within the scope of this policy and the procedures as explained in the paragraph above.
This policy and authorization have been explained to me in a language I understand, and I have been told that if I have any questions about the test or the policy, they will be answered.
I UNDERSTAND THAT THE COMPANY WILL REQUIRE A DRUG SCREEN AND/OR ALCOHOL TEST UNDER THIS POLICY UNDER THE FOLLOWING CIRCUMSTANCES:

  • Each individual who has been offered a first time position with the Company will be required to undergo a Drug and Alcohol Screen and successfully pass the drug and alcohol screen. Those applicants that test positive to illegal drugs will not be considered eligible for employment.
  • If an employee is suspected of using or being under the influence of unauthorized drugs or alcohol during Company hours, the direct supervisor of the employee may request an immediate drug test by urine, blood and/or hair for that employee. The request will be forwarded for approval to the Department Supervisor or management.
  • Employees who are involved in an on-the-job accident that requires medical treatment or that involves damage to property will be required to submit to a drug test or when required a blood alcohol test.
